Terms of Service

1. Acceptance of Terms

By creating an account or using Capsule ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users, including sponsors (family members who set up a Capsule) and storytellers (the individuals being interviewed).

2. Description of Service

Capsule is a platform that enables families to preserve life stories through guided, AI-assisted audio interviews. The Service includes voice interview sessions, transcription, AI-generated highlights ("Moments"), and a family portal for reviewing and sharing recorded memories.

3. Accounts and Eligibility

To create a sponsor account, you must be at least 18 years old. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

Storyteller access is provided via a PIN issued by the account holder. You are responsible for sharing that PIN only with the intended storyteller.

4. User Content and Recordings

You retain ownership of all audio recordings, transcripts, and content generated through your use of the Service ("User Content"). By using Capsule, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for ensuring that all individuals whose voice or likeness is recorded have provided their informed consent to be recorded and for their recordings to be stored and shared within the platform.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We take the privacy of personal stories seriously and will not sell your data to third parties.

6. Acceptable Use

You agree not to use the Service to:

• Record individuals without their consent
• Upload or generate content that is unlawful, harmful, threatening, or abusive
• Attempt to reverse-engineer, scrape, or disrupt the Service
• Impersonate any person or entity
• Use the Service for any commercial purpose other than as expressly permitted

7. AI-Generated Content

The Service uses artificial intelligence to assist with interview questions, transcription, and extracting meaningful Moments from conversations. While we strive for accuracy, AI-generated content may contain errors or omissions. You are responsible for reviewing and verifying any AI-generated content before relying on or sharing it.

8. Data Retention and Deletion

You may request deletion of your account and associated data at any time by contacting us. Upon account deletion, your recordings and transcripts will be permanently removed from our systems within 30 days, except where retention is required by law.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that recordings will be preserved indefinitely. We strongly encourage you to download and back up your recordings regularly.

10. Limitation of Liability

To the fullest extent permitted by law, Capsule and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data or recordings.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of Capsule after changes take effect constitutes your acceptance of the revised Terms.
